I may also add, that anybody can also play a Medieval Fantasy RPG that uses the same rules for Stat distribution and combat as D&D.
Basically, nobody has any power to stop people from implementing rules in other games, or doing homebrewed creations.
As long as we are not selling it as either HeroQuest or Dungeons and Dragons.

On the other hand, like many games out there, they could try and demand people take down "derivative works" at least temporarily. I wouldn't agree with it if they did, of course (and it would decrease goodwill with the fans). Plenty of generic game templates are out there, it's the publicly available stuff that's more sensitive I imagine. I'm saying don't throw your stuff away just yet... grab it while you can!
